In Vmetasoft corporation, we respect your concern about the collection and the usage of your Personal Information. The following privacy policies is made for the different ways your Personal Information may be collected, used, shared and processed by different Vmetasoft lines of business:

 

The Vmetasoft General policy address the personal information that we collect from you when you interact with our websites, mobile application, email, phone call, other offline sales and marketing activities including newspaper, telegraph and magazine.

 

This Privacy Policy was last updated on 7th May 2020. However, the Privacy Policy can change over time, for example to comply with legal requirements or to meet changing business needs. The most up-to-date version can be found on this website. In case there is an important change that we want to highlight to you, we will also inform you in another appropriate way (for example via a pop-up notice or statement of changes on our website). The given privacy policy was last updated on 8th May 2020 and subject to update time to time in order to comply with international standard. It describes our privacy and security practices in brief or handing our customer data:

 

  1. INTRODUCTION

 

This General Vmetasoft Privacy Policy (also referred as legal policy here ) provides information on the collection, use, and sharing (collectively referred to ‘processing’ or ‘process’) as of personal information by Vmetasoft Corporation and its affiliates (“Vmetasoft”, “we” or “us”) in contrast to the use of Vmetasoft websites, mobile applications, social media pages and other offline and online interaction that link to this Privacy Policy, your interactions with Vmetasoft during your personal meeting online, offline or during the events. This Privacy Policy also explains the privacy rights you have in relation to these processing activities.

As used in this Privacy Policy, ‘personal information’ or ‘personal data’ means information that relates to an identified individual or to an identifiable individual. For example, this could include among other things your name, address, email address, business contact details, or information gathered through your interactions with us via our websites or at events. Personal information is also referred to as ‘information about you.’ For more detail about the types of information about you that we may process, please refer to Section 4 below.

 

 

Vmetasoft Services Policy

 

This Vmetasoft Services Policy (“can also be referred as Services Privacy Policy”) is organized into three sections:

 

  • The first section (Services Personal Information Data Processing Terms) describes the privacy and security practices that Vmetasoft Corporation and its affiliates (“Vmetasoft”) employ when handling Services Personal Information (as defined below) for the provision of Technical Support, Consulting, Cloud or other services (the “Services”) provided to Vmetasoft customers (“You” or “Your”) during the term of Your order for Services.

Services Personal Information is personal information that is provided by You, resides on Vmetasoft, customer or third-party systems and environments, and is processed by Vmetasoft on Your behalf in order to perform the Services. Services Personal Information may include, depending on the Services: information concerning family, lifestyle and social circumstances; employment details; financial details; online identifiers such as mobile device IDs and IP addresses, and first party online behavior and interest data. Services Personal Information may relate to Your representatives and end users, such as Your employees, job applicants, contractors, collaborators, partners, suppliers, customers and clients.

 

  • The second section (System Operations Data Processing Terms) describes the privacy and security practices that apply to personal information that may be incidentally contained in Systems Operation Data that is generated by the interaction of (end-)users of our Services (“Users”) with the Vmetasoft systems and networks used to monitor, safeguard and deliver Services to our customer base.

 

Systems Operations Data may include log files, event files, and other trace and diagnostic files, as well as statistical and aggregated information that relates to the use and operation of our Services, and the systems and networks these Services run on.

 

III. The third section (Communications and Notifications to Customers and Users) applies to both Services Personal Information and personal information contained in Systems Operations Data, describes how Vmetasoft handles legally required disclosure requests, and informs You and Users how to communicate with Vmetasoft’s Global Data Protection Officer or file a complaint.

 

 

 

The definitions of Services Personal Information and Systems Operations Data do not include Your or User contact and related information collected from the use of Vmetasoft websites, or Your or User interactions with us during the contracting process. Vmetasoft’s handling of this information is subject to the terms of the General Vmetasoft Privacy Policy.

 

 

 

 

 

  1. SERVICES PERSONAL INFORMATION DATA PROCESSING TERMS

 

Vmetasoft treats all Services Personal Information in accordance with the terms of Sections I and III of this Policy and Your order for Services.

 

In the event of any conflict between the terms of this Services Privacy Policy and any privacy terms incorporated into Your order for Services, including an Vmetasoft Data Processing Agreement, the relevant privacy terms of Your order for Services shall take precedence.

  1. Performance of the Services

Vmetasoft may process Services Personal Information for the processing activities necessary to perform the Services, including for testing and applying new product or system versions, patches, updates and upgrades, and resolving bugs and other issues You have reported to Vmetasoft.

 

  1. Customer instructions

You are the controller of the Services Personal Information processed by Vmetasoft to perform the Services. Vmetasoft will process your Services Personal Information as specified in Your Services order and Your documented additional written instructions to the extent necessary for Vmetasoft to (i) comply with its processor obligations under applicable data protection law or (ii) assist You to comply with Your controller obligations under applicable data protection law relevant to Your use of the Services. Vmetasoft will promptly inform You if, in our reasonable opinion, your instruction infringes applicable data protection law. Additional fees may apply.

 

 

  1. Rights of individuals

You control access to Your Services Personal Information by Your end users, and Your end users should direct any requests related to their Services Personal Information to You. To the extent such access is not available to You, Vmetasoft will provide reasonable assistance with requests from individuals to access, delete or erase, restrict, rectify, receive and transmit, block access to or object to processing of Services Personal Information on Vmetasoft systems.

 

  1. Security and confidentiality

Vmetasoft has implemented and will maintain technical and organizational measures designed to prevent accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to Services Personal Information. These measures, which are generally aligned with the ISO/IEC 27001:2013 standard, govern all areas of security applicable to the Services, including physical access, system access, data access, transmission, input, security oversight, and enforcement.

 

Vmetasoft employees are required to maintain the confidentiality of personal information. Employees' obligations include written confidentiality agreements, regular training on information protection, and compliance with company policies concerning protection of confidential information.

  1. Incident Management and data breach notification.

Vmetasoft promptly evaluates and responds to incidents that create suspicion of or indicate unauthorized access to or handling of Services Personal Information.

 

If Vmetasoft becomes aware and determines that an incident involving Services Personal Information qualifies as a breach of security leading to the misappropriation or accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, Services Personal Information transmitted, stored or otherwise processed on Vmetasoft systems that compromises the security, confidentiality or integrity of such Services Personal Information, Vmetasoft will report such breach to You without undue delay.

 

As information regarding the breach is collected or otherwise reasonably becomes available to Vmetasoft and to the extent permitted by law, Vmetasoft will provide You with additional relevant information concerning the breach reasonably known or available to Vmetasoft.

 

 

  1. Audit rights

 

To the extent provided in your order for Services, you may at Your sole expense audit Vmetasoft’s compliance with the terms of this Services Privacy Policy by sending Vmetasoft a written request, including a detailed audit plan, at least six weeks in advance of the proposed audit date. You and Vmetasoft will work cooperatively to agree on a final audit plan.

 

The audit shall be conducted no more than once during a twelve-month period, during regular business hours, subject to Vmetasoft’s on-site policies and regulations, and may not unreasonably interfere with business activities. If You would like to use a third party to conduct the audit, the third-party auditor shall be mutually agreed to by the parties and the third-party auditor must execute a written confidentiality agreement acceptable to Vmetasoft. Upon completion of the audit, you will provide Vmetasoft with a copy of the audit report, which is classified as confidential information under the terms of Your agreement with Vmetasoft.

 

Vmetasoft will contribute to such audits by providing You with the information and assistance reasonably necessary to conduct the audit, including any relevant records of processing activities applicable to the Services. If the requested audit scope is addressed in a SOC 1 or SOC 2, ISO, NIST, PCI DSS, HIPAA or similar audit report issued by a qualified third party auditor within the prior twelve months and Vmetasoft provides such report to You confirming there are no known material changes in the controls audited, You agree to accept the findings presented in the third party audit report in lieu of requesting an audit of the same controls covered by the report. Additional audit terms may be included in Your order for Services.

 

  1. Deletion or return of Services Personal Information

Except as otherwise specified in an order for services or required by law, upon termination of services or at your request, Vmetasoft will delete your production customer data located on Vmetasoft computers in a manner designed to ensure that they cannot reasonably be accessed or read, unless there is a legal obligation imposed on Vmetasoft preventing it from deleting all or part of the data. You may consult with your Vmetasoft services contact for additional information on data deletion prior to service completion.

 

 

 

  1. SYSTEMS OPERATIONS DATA PROCESSING TERMS

 

  1. Responsibility and purposes for processing personal information

Vmetasoft Corporation and its affiliated entities are responsible for processing personal information that may be incidentally contained in Systems Operations Data in accordance with Sections II and III of this Policy. See the list of Vmetasoft entities. Please select a region and country to view the registered address and contact details of the Vmetasoft entity or entities located in each country.

 

We may collect or generate Systems Operations Data for the following purposes:

 

a) to help keep our Services secure, including for security monitoring and identity management;

b) to investigate and prevent potential fraud or illegal activities involving our systems and networks, including to prevent cyber-attacks and to detect bots;

c) to administer our back-up disaster recovery plans and policies;

d) to confirm compliance with licensing and other terms of use (license compliance monitoring);

e) for research and development purposes, including to analyze, develop, improve and optimize our Services;

f) to comply with applicable laws and regulations and to operate our business, including to comply with legally mandated reporting, disclosure or other legal process requests, for mergers and acquisitions, finance and accounting, archiving and insurance purposes, legal and business consulting and in the context of dispute resolution.

 

 

For personal information contained in Systems Operations Data collected in the EU, our legal basis for processing such information is our legitimate interest in performing, maintaining and securing our products and services and operating our business in an efficient and appropriate manner. Personal information may also be processed based on our legal obligations or legitimate interest to comply with such legal obligations.

  1. Sharing personal information

 

Personal information contained in Systems Operations Data may be shared throughout Vmetasoft's global organization. A list of Vmetasoft entities is available as indicated above.

 

We may also share such personal information with the following third parties:

 

third-party service providers (for example IT service providers, lawyers and auditors) in order for those service providers to perform business functions on behalf of Vmetasoft;

relevant third parties in the event of a reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings);

as required by law, such as to comply with a subpoena or other legal process, when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to government requests, including public and government authorities outside your country of residence, for national security and/or law enforcement purposes.

 

 

When third parties are given access to personal information contained in Systems Operations Data, we will take the appropriate contractual, technical and organizational measures to ensure, for example, that personal information is only processed to the extent that such processing is necessary, consistent with this Privacy Policy and in accordance with applicable law.

 

  1. Security

Vmetasoft has implemented appropriate technical, physical and organizational measures in accordance with the Vmetasoft Corporate Security Practices designed to protect personal information against accidental or unlawful destruction or accidental loss, damage, alteration, unauthorized disclosure or access as well as all other forms of unlawful processing (including, but not limited to, unnecessary collection) or further processing.

 

  1. User choices

To the extent provided under applicable laws, Users may request to access, correct, update or delete personal information contained in Systems Operations Data in certain cases, or otherwise exercise their choices with regard to their personal information by filling out an inquiry form.

 

 

III. COMMUNICATIONS AND NOTIFICATIONS TO CUSTOMERS AND USERS

  1. Legal requirements.

Vmetasoft may be required to provide access to Services Personal Information and to personal information contained in Systems Operations Data as required by law, such as to comply with a subpoena or other legal process, when we believe in good faith that disclosure is necessary to protect our rights, protect Your or a User’s safety or the safety of others, investigate fraud, or respond to government requests, including public and government authorities outside Your or a User’s country of residence, for national security and/or law enforcement purposes.

 

Vmetasoft will promptly inform You of requests to provide access to Services Personal Information, unless otherwise required by law.

  1. Global Data Protection Officer

 

Vmetasoft has appointed a Data Protection Officer. If You or a User believe that personal information has been used in a way that is not consistent with this Privacy Policy, or if You or a User have further questions, comments or suggestions related to Vmetasoft’s handling of Services Personal Information or personal information contained in Systems Operations Data, please contact the Data Protection Officer by filling out an inquiry form.

  1. WHY AND HOW DO WE USE YOUR PERSONAL INFORMATION?

We use personal information for the following purposes:

for recruitment, evaluation, background screening and hiring purposes

to enable your use of the Vmetasoft Career Portal

to analyze, develop and improve the Vmetasoft Career Portal, our recruiting activities and Vmetasoft products and services

To communicate with you and respond to your requests or application

 

 

If you get in touch with us (for example, through Vmetasoft Career Portal, contact forms on the Sites, contact with our recruiters or at events or via Sites) we process information about you to communicate with you about your application or job interests. For example, we may update you on the status of your application, inform you about new vacancies or invite you for recruitment activities such as a phone or in-person interview.

 

  1. For recruitment, evaluation, and background screening and hiring purposes

We process information about you to connect the right candidate with the right job at Vmetasoft and evaluate whether you are the right applicant for a position. We may therefore include information about you in our recruitment databases to manage Vmetasoft’s candidate selection and recruiting processes. If you are selected for a position at Vmetasoft, information about you will also be used to facilitate the hiring process. Please be aware that, prior to hiring you and in order for Vmetasoft to be able to extend an offer to you, you may be requested to complete a background check in accordance with Vmetasoft policies and local law. Depending on your region, additional details regarding our use of background check information about you may also be specified in the applicable privacy notices and/or policies of our background check service provider.

 

Vmetasoft may invite you to participate in assessments to evaluate your suitability for a position. In evaluating your suitability for the position, Vmetasoft may access your assessment and receive results from the Sites.

 

 

In order to analyze, develop and improve Vmetasoft Career Portal, our recruiting activities and Vmetasoft products and services, Vmetasoft may process information about you, for example if you encountered any problems in using Vmetasoft Career Portal or if it is not functioning as expected. We may also process information about you to develop and test new products or system versions, patches and updates.

 

To maintain the security of the Vmetasoft career portal, we may use personal information about you as necessary to maintain the security of the Vmetasoft Talent Acquisition Cloud, and our sites, systems and networks. For example, we may process information about you when investigating suspicious activity on our sites, systems and networks.

 

To comply with applicable laws and regulations and to operate our business we may process information about you to comply with applicable laws and regulations, such as legally mandated reporting or other legal process requests. We may also process information about you in the performance and organization of our business and internal management, for example to conduct audits and investigations, for mergers and acquisitions, finance and accounting, archiving and insurance purposes and in the context of dispute resolution.

 

 

  1. FOR HOW LONG DO WE RETAIN PERSONAL INFORMATION?

Vmetasoft maintains your personal information for the following retention periods:

If you have created an account on the Vmetasoft career portal, your account information will be retained for as long as you maintain an active account. Your account will be deemed inactive, and your account information will be deleted, after three (3) years of inactivity.

Vmetasoft will retain your personal information related to your application for a position (such as your curriculum vitae/resume or the position to which you applied, assessment results) for up to three (3) years from the date you applied (unless a longer or shorter period is required by applicable law).

 

 

To the extent permitted or required by law, or as requested by you, Vmetasoft may delete your personal information at any time. As a result, you should retain your own copy of any information you submit to us.

 

  1. WHEN AND HOW CAN WE SHARE YOUR PERSONAL INFORMATION?

Sharing within Vmetasoft

As a global organization information about you may be shared globally throughout Vmetasoft’s worldwide organization. A list of Vmetasoft entities with which information about you can be shared is available here. Vmetasoft employees are authorized to access personal information only to the extent necessary to serve the applicable purpose and to perform their jobs and are bound by appropriate confidentiality agreements.

 

Sharing with third parties

Where necessary, we share personal information with the third parties described below.

Third-party service providers (for example, website management, information technology and related infrastructure provision, background or employment check service providers, auditing, and other similar services) in order for those service providers to perform business functions on behalf of Vmetasoft.

Relevant third parties in the event of a reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, assets or stock (including in connection with any bankruptcy or similar proceedings).

As required by law, such as to comply with a subpoena or other legal process, when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to government requests, including public and government authorities outside your country of residence, for national security and/or law enforcement purposes.

 

When third parties are given access to your personal information, we require them to abide by contractual, technical and organizational measures designed to ensure that your personal information is processed only to the extent that such processing is necessary, consistent with this Privacy Policy, and in accordance with applicable law. Note that some of these third parties, such as our background check service providers may also maintain additional privacy policies and notices on behalf of Vmetasoft.

 

 

 

  1. HOW IS PERSONAL INFORMATION HANDLED GLOBALLY?

Vmetasoft is a global corporation with operations in over 3 countries and personal information is transferred, accessed and stored globally including in countries or regions outside of the one in which you reside. If your personal information is transferred to an Vmetasoft recipient or third party in a country that does not provide an adequate level of protection for personal information Vmetasoft will take measures designed to ensure that your personal information is adequately protected, such as making it subject to the terms of the EU Standard Contractual Clauses.

 

  1. HOW IS YOUR PERSONAL INFORMATION SECURED?

Vmetasoft has implemented appropriate technical, physical and organizational measures designed to protect your personal information against accidental or unlawful destruction or accidental loss, damage, alteration, unauthorized disclosure or access as well as all other forms of unlawful processing (including, but not limited to, unnecessary collection) or further processing.

 

  1. WHAT ARE YOUR CHOICES?

Depending on your country of residence, you may have certain choices and rights in relation to our use of information about you, such as the right to access, correct and update, erase or delete, and obtain a copy of your personal information.

 

    Withdraw consent - You may request to withdraw the consent you have previously provided for the processing of your personal information.

Delete personal information - You can erase or delete all or some of your personal information in the Vmetasoft career portal.

Change or correct personal information - You can edit some of your personal information in the Vmetasoft career portal.

Object to, or limit or restrict use of personal information - You can ask us to stop using all or some of your personal information.

Right to access and/or receive a copy of your personal information - You can also obtain a copy of some of your personal information in machine readable form in the Vmetasoft career portal.

 

 

  1. DOES VMETASOFT COLLECT SENSITIVE PERSONAL INFORMATION?

Vmetasoft does not request or require and asks that you do not send us any sensitive personal information, such as details concerning racial or ethnic origin, religion or philosophical beliefs, health, sexual orientation, or political affiliation in connection with your job application and our recruiting efforts. To the extent information you do provide to us contains sensitive information, for example details of your racial or ethnic origin, political opinions or beliefs, religious beliefs, membership in a trade union or political party, physical or mental health or condition, sexual orientation, commission or alleged commission of an offense or related proceedings, job evaluations or educational records, you explicitly authorize Vmetasoft to process this personal information as described in this Privacy Policy. The processing by Vmetasoft of your voice recordings or image, or behavior, personality or other psychometric information are subject to the Supplemental Recruiting Privacy Policy terms.

 

Additionally, if you have a disability and would like Vmetasoft to consider any accommodation, you may provide that information during the recruiting process. In some countries, in accordance with applicable law, we may explicitly ask for information such as race or ethnicity for the purpose of monitoring equal opportunity. However, we do not require applicants to provide this information in connection with their job application and our recruiting efforts, and if you choose to provide this information as part of our equal opportunity program, it will not be viewable or otherwise used in the hiring or selection process.

 

  1. WHAT ARE YOUR RESPONSIBILITIES?

You are responsible for the personal information that you provide or make available to Vmetasoft, and you must ensure it is relevant, truthful, accurate and not misleading in any way. You must ensure that the information provided does not contain material that is obscene, defamatory, or infringing on any rights of any third party; does not contain malicious code; and is not otherwise legally actionable. Further, if you provide any personal information concerning any other person, such as individuals you provide as references, you are responsible for providing any notices and obtaining any consents necessary for Vmetasoft to collect and use that information as described in this Privacy Policy.

In addition to the terms you accepted when you applied on Vmetasoft’s Recruiting Site, you hereby agree to these supplemental terms of use and use of your personal information as set out in these Supplemental Recruiting Privacy Policy Terms (Supplemental Privacy Policy). Information learned about you as a result of assessments or evaluations can include certain types of data about your personality, behavior and suitability for a particular position. Personal information captured in a video recording may include personal information such as your voice and image. Sensitive personal information also includes information revealed in a video interview such as racial or ethnic origin, religion or philosophical beliefs, sexual orientation, membership in a trade union, political affiliation, physical or mental health or condition, commission or alleged commission of an offense or related proceedings or job evaluations or educational records. Vmetasoft does not require and asks that you do not provide such types of personal information. If you do not consent to your personal information being used as set out in this Supplemental Privacy Policy, do not apply through this process. If you would like Vmetasoft to consider any accommodation, please contact career@Vmetasoft.com and Vmetasoft may offer an accommodation, such as a phone interview, in accordance with the Privacy Policy.

 

Vmetasoft will store a copy of the interview in accordance with its retention policies but will not retain the video for longer than is necessary to evaluate a candidate or as is otherwise permissible by applicable law. You understand that Vmetasoft will not advance all candidates nor will submission of a video interview guarantee a job offer. Vmetasoft does not want to receive confidential information from you through or in connection with the Site. Vmetasoft's trademarks and service marks ("Vmetasoft trademarks") are valuable assets of Vmetasoft which is being registered and protected under international law and regulatory body. We ask our affiliates and partners by help us by properly using and crediting Vmetasoft trademarks in accordance with these guidelines.

 

Vmetasoft and its associates may use our trademarks to refer to the associated Vmetasoft products or services. For instance, an authorized reseller can note in its advertisements that it is selling the Vmetasoft application server. Similarly, a Vmetasoft customer may issue a press release stating that it has implemented Vmetasoft products or services.

 

Relationship of Products or Services

You may indicate the relationship of your products or services to Vmetasoft products or services by using accurate, descriptive tag lines such as "for Vmetasoft database," "for use with Vmetasoft E-Business Suite applications," and "works with Vmetasoft software" in connection with your product or service name. Within text or body copy, such tag lines may appear in the same type as your product or service name. On product, packaging, advertising and other collateral where your product or service name is displayed apart from body copy, make sure that the tag line appears in significantly smaller type than your name. "Vmetasoft" As a Trade Name

Trade names are the actual business names of companies. Trademarks and trade names are not the same, even though many companies use their trade names as trademarks. If you are using "Vmetasoft" as a substitute for Vmetasoft Corporation, you are using it as a trade name. Because they are nouns, trade names can be used in the possessive and do not require a generic term or a trademark symbol.   1. SERVICES PERSONAL INFORMATION DATA PROCESSING TERMS

 

Vmetasoft treats all Services Personal Information in accordance with the terms of Sections I and III of this Policy and Your order for Services.

 

In the event of any conflict between the terms of this Services Privacy Policy and any privacy terms incorporated into Your order for Services, including an Vmetasoft Data Processing Agreement, the relevant privacy terms of Your order for Services shall take precedence.

  1. Performance of the Services

Vmetasoft may process Services Personal Information for the processing activities necessary to perform the Services, including for testing and applying new product or system versions, patches, updates and upgrades, and resolving bugs and other issues You have reported to Vmetasoft.

 

  1. Customer instructions

You are the controller of the Services Personal Information processed by Vmetasoft to perform the Services. Vmetasoft will process your Services Personal Information as specified in Your Services order and Your documented additional written instructions to the extent necessary for Vmetasoft to (i) comply with its processor obligations under applicable data protection law or (ii) assist You to comply with Your controller obligations under applicable data protection law relevant to Your use of the Services. Vmetasoft will promptly inform You if, in our reasonable opinion, your instruction infringes applicable data protection law. Additional fees may apply.

 

 

  1. Rights of individuals

You control access to Your Services Personal Information by Your end users, and Your end users should direct any requests related to their Services Personal Information to You. To the extent such access is not available to You, Vmetasoft will provide reasonable assistance with requests from individuals to access, delete or erase, restrict, rectify, receive and transmit, block access to or object to processing of Services Personal Information on Vmetasoft systems.

 

  1. Security and confidentiality

Vmetasoft has implemented and will maintain technical and organizational measures designed to prevent accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to Services Personal Information. These measures, which are generally aligned with the ISO/IEC 27001:2013 standard, govern all areas of security applicable to the Services, including physical access, system access, data access, transmission, input, security oversight, and enforcement.

 

Vmetasoft employees are required to maintain the confidentiality of personal information. Employees’ obligations include written confidentiality agreements, regular training on information protection, and compliance with company policies concerning protection of confidential information.

  1. Incident Management and data breach notification.

Vmetasoft promptly evaluates and responds to incidents that create suspicion of or indicate unauthorized access to or handling of Services Personal Information.

 

If Vmetasoft becomes aware and determines that an incident involving Services Personal Information qualifies as a breach of security leading to the misappropriation or accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, Services Personal Information transmitted, stored or otherwise processed on Vmetasoft systems that compromises the security, confidentiality or integrity of such Services Personal Information, Vmetasoft will report such breach to You without undue delay.

 

As information regarding the breach is collected or otherwise reasonably becomes available to Vmetasoft and to the extent permitted by law, Vmetasoft will provide You with additional relevant information concerning the breach reasonably known or available to Vmetasoft.

 

 

  1. Audit rights

 

To the extent provided in your order for Services, you may at Your sole expense audit Vmetasoft’s compliance with the terms of this Services Privacy Policy by sending Vmetasoft a written request, including a detailed audit plan, at least six weeks in advance of the proposed audit date. You and Vmetasoft will work cooperatively to agree on a final audit plan.

 

The audit shall be conducted no more than once during a twelve-month period, during regular business hours, subject to Vmetasoft’s on-site policies and regulations, and may not unreasonably interfere with business activities. If You would like to use a third party to conduct the audit, the third-party auditor shall be mutually agreed to by the parties and the third-party auditor must execute a written confidentiality agreement acceptable to Vmetasoft. Upon completion of the audit, you will provide Vmetasoft with a copy of the audit report, which is classified as confidential information under the terms of Your agreement with Vmetasoft.

 

Vmetasoft will contribute to such audits by providing You with the information and assistance reasonably necessary to conduct the audit, including any relevant records of processing activities applicable to the Services. If the requested audit scope is addressed in a SOC 1 or SOC 2, ISO, NIST, PCI DSS, HIPAA or similar audit report issued by a qualified third party auditor within the prior twelve months and Vmetasoft provides such report to You confirming there are no known material changes in the controls audited, You agree to accept the findings presented in the third party audit report in lieu of requesting an audit of the same controls covered by the report. Additional audit terms may be included in Your order for Services.

 

  1. Deletion or return of Services Personal Information

Except as otherwise specified in an order for services or required by law, upon termination of services or at your request, Vmetasoft will delete your production customer data located on Vmetasoft computers in a manner designed to ensure that they cannot reasonably be accessed or read, unless there is a legal obligation imposed on Vmetasoft preventing it from deleting all or part of the data. You may consult with your Vmetasoft services contact for additional information on data deletion prior to service completion.

 

 

 

  1. SYSTEMS OPERATIONS DATA PROCESSING TERMS

 

  1. Responsibility and purposes for processing personal information

Vmetasoft Corporation and its affiliated entities are responsible for processing personal information that may be incidentally contained in Systems Operations Data in accordance with Sections II and III of this Policy. We may collect or generate Systems Operations Data for the following purposes:

Vmetasoft does not require and asks that you do not provide such types of personal information. Vmetasoft’s trademarks and service marks (“Vmetasoft trademarks”) are valuable assets of Vmetasoft which is being registered and protected under international law and regulatory body. We ask our affiliates and partners by help us by properly using and crediting Vmetasoft trademarks in accordance with these guidelines.

 

Vmetasoft and its associates may use our trademarks to refer to the associated Vmetasoft products or services. For instance, an authorized reseller can note in its advertisements that it is selling the Vmetasoft application server. Similarly, a Vmetasoft customer may issue a press release stating that it has implemented Vmetasoft products or services.

 

Relationship of Products or Services

You may indicate the relationship of your products or services to Vmetasoft products or services by using accurate, descriptive tag lines such as “for Vmetasoft database,” “for use with Vmetasoft E-Business Suite applications,” and “works with Vmetasoft software” in connection with your product or service name. Within text or body copy, such tag lines may appear in the same type as your product or service name. On product, packaging, advertising and other collateral where your product or service name is displayed apart from body copy, make sure that the tag line appears in significantly smaller type than your name. Titles

Vmetasoft permits use of its marks in single volume book titles (not magazines or periodicals) where such use is descriptive or referential. To avoid misleading the public as to Vmetasoft sponsorship, affiliation or endorsement, the Vmetasoft mark must not appear more prominently than the rest of the title, and do not use Vmetasoft logos on the cover. User Groups

Trade names are the actual business names of companies. Trademarks and trade names are not the same, even though many companies use their trade names as trademarks. If you are using “Vmetasoft” as a substitute for Vmetasoft Corporation, you are using it as a trade name. Because they are nouns, trade names can be used in the possessive and do not require a generic term or a trademark symbol.
